Ms. Yang Lin introduced a case of YK Law LLP’s successful recognition and enforcement of a domestic arbitration institution’s award: in August this year, a successful judgment in the U.S. Federal District Court of Massachusetts to recognize and enforce an arbitration award made by the Guangzhou Arbitration Commission last November 2020 based on the New York Convention and the U.S. Federal Arbitration Act. In September this year, during CIETAC’s China Arbitration Week series, Yingke, together with Hong Kong law firm Roxas & Partners and WK, held the first seminar in the Interpreting International Arbitration series, which focused on interim measures in international arbitration. Ms. Yang Lin also made her suggestions at the same time, firstly, domestic arbitration institutions can refer to world-renowned arbitration institutions and enhance their flexibility in the list of arbitrators; secondly, they should give full play to their geographical advantages and become the preferred arbitration institution for dispute resolution in the Guangdong, Hong Kong and Macau region.
In recent years, as the international dispute resolution mechanism continues to diversify and the demand for international and domestic commercial legal services continues to strengthen, Yingke, as a global legal institution, is committed to providing one-stop legal services for global clients. In order to strengthen the construction of foreign-related laws and provide better legal services to clients in the field of civil and commercial arbitration, Yingke Law Firm held the Yingke Arbitration Forum and established the Yingke arbitration legal service center this year. Based on the New York Convention, we have represented a number of Chinese enterprises and individuals in the recognition and enforcement of arbitral awards made by Chinese arbitral institutions in the United States, the United Kingdom, Russia, Saudi Arabia, Brazil and other countries, involving arbitration institutions such as the Trade Arbitration Commission, the Beijing Arbitration Commission, the Guangzhou Arbitration Commission, the Shanghai Arbitration Commission and the Xi’an Arbitration Commission. In the future, we will continue to rely on Yingke’s strong international service network platform to help our clients solve arbitration enforcement problems worldwide.
