On the afternoon of May 20, 2023, Forum on High Quality Development of China Arbitration, Forum on China Enterprise Cross Border Investment and Compliance, Establishment Ceremony of Yingke International Arbitration and Mediation Research Institute and Establishment Ceremony of Yingke Global ESG Center were successfully held on the fourth floor of CP Center.

Keynote Speech

Shen Sibao, the director made a speech on international arbitration from the development and task of Chinese arbitration and the problems of domestic arbitration research. Director Shen said that China’s arbitration has developed rapidly, with its scale and speed ranking among the highest in the world. Director Shen also mentioned that domestic arbitration research faces two problems. First, the Arbitration Law needs to adapt to the development and be revised accordingly. Second, lawyers should study and solve new problems in practice. In the future, Yingke International Arbitration and Mediation Research Institute will focus on international commercial arbitration and mediation, and contribute to the development of arbitration in China.

Tan Jian, secretary-general made a speech on the theme of “Combining Theory and Practice and Jointly Promote the High-quality Development of Arbitration in China”. The establishment of Yingke International Arbitration and Mediation Research Institute is conducive to improving the competitiveness of the law firm. For China’s arbitration, it is also conducive to promoting the development of the industry. He introduced the new historical opportunities for high-quality development of arbitration from five aspects: macro environment, market demand, policy, industry competition and domestic institutions. In addition, he also introduced the prominent contradictions and problems facing the high-quality development of arbitration in China, and put forward five suggestions of strengthening legislative research, promoting investigation and research, carrying out professional training, promoting academic exchanges and publicizing arbitration. Finally, he said that China Academy of Arbitration Law is willing to strengthen cooperation with Yingke to jointly promote the development of arbitration.

Hu Zhenjie, General Manager said the establishment of Yingke International Arbitration and Mediation Research Institute is timely and fully reflects the commitment of Yingke Law Firm. He shared his personal experience from the perspectives of arbitrators and entrepreneurs, focusing on the four major issues including institutional setting, the role of ad hoc arbitration, the relationship between international and domestic arbitration and the constraints on arbitrators, which is inspiring and instructive.

Guido Bartalini shared the new trends of Italian arbitration reform from the perspective of Italian arbitration practice.

Chen Yin shared on the topic of “Opportunities and Challenges Brought by the High Quality Development of Arbitration for Chinese Lawyers”, discussing the understanding of the system from the perspective of arbitration practice in Australia.

Forum on China Enterprise Cross Border Investment and Compliance

Yang Lin, Founding partner of Yingke International, Global Partner, Executive Chairwoman of Global Board, gave a keynote speech on “Building ESG System and Promoting Compliance Construction”, mainly introducing the origin of ESG, six investment principles of UNPRI, Sustainable Development Goals, ESG key words, ESG rating agencies, etc. She also introduced the establishment and improvement of corporate ESG system and management system by focusing on the origin and division of responsibilities and authority, the establishment of responsible institutions, the establishment of implementing institutions, the construction of monitoring and decision-making system and the reporting path. Finally, Director Yang said that ESG is an important consideration for enterprises to grasp opportunities and manage risks when making cross-border investments.

Francesco Sciaudone, Managing Partner of Grimaldi Alliance, explained the importance of ESG and how to understand it from an EU perspective, stating that a global legal services network can help to understand and respect local laws and to make better investments. When making cross-border investments, it is necessary to strengthen communication with local partners and fully understand the legal requirements in the region to avoid risks. In addition, he stressed that all legal practitioners should contribute more effective suggestions. Lastly, with the support of experts and lawyers, he would continue to improve his business capabilities and provide more professional legal services on ESG and compliance issues in a one-stop manner.

Andreas Köhler shared his views on Chinese investment in Germany, especially in sectors that are strictly regulated by the German government. In addition, he mentioned that renewable energy is an important to green and sustainable investments.

Eyal Khayat answered the question about the characteristics of Chinese investment in Israel. He also supported the idea that startups need a portfolio of products to hedge their risks.

Ivana Kopilovic shared compliance issues that Chinese investors need to be aware of when investing in Serbia. In addition, he shared how Serbia can maintain good trade relations with both China and Europe.

Renato Pacheco Neto shared successful cases of Chinese companies such as Huawei and Sinopec investing in Brazil, and said the benefit of investing in emerging markets is to inject a new way of investment and lifestyle into the region.

Paurush Kumar stated that India has different laws at the central and local levels and that there will be uniform laws to make international investment easier.

Lu Hui answered the question of what Chinese companies need to prepare in advance for investing in Germany.
